I want to move to the same state as my son, 409 to 458.. will the rules change after DD season has finished?

If you are above level 6 then you have to use the state immigration event option once you reach level 10. The immigration rules have changed recently. You can only move to states that are in the same DD season. I am not sure if the two states you mentioned will ever be in the same DD season. You can wait until the season ends as you said and try again though.
