There are no level 2 empty plots. During RoC the map is split into 4 bands or areas. The outer ring (around the edge of the map) has rss plots from 1 to 5 but all empty plots are level 1. The next area closer in is level 5 to 9 and all empty plots are level 5.

I try to take level 3 plots but it says I need a level 2 plot?

The RoC quest says occupy a level 2 territory. Is this different than a level 2 plot?

It it the same, the game calls them territories, most players call them tiles or plots.
