Where are the troops station in the defensive "Formation I" if decided not to let my legion join the defensive formation in the garrison?

They are in your city but will not fight to defend. This can help save some of your troops if you are attacked by a strong enemy but you will still lose troops overall when you are defeated.

So if you let the legions checked in the garrison, but empty them out, it would yield the same result, right? There will still be some casualties?

Yes, any troops in your city that are not part of a legion will also defend and you will suffer 'defeat casualties' or similar. The only way to save troop losses is to put them in a legion and send them out, to gather perhaps, far away.
